Marigot:--- The Criminal Courts in St. Martin condemned former State employee Yannick Beaud on February 14th, 2013. Beaud and his family received the bad news on Valentine's Day when the judges from the criminal courts pronounced their decision. Beaud received a fine of Euros 10,000 for not following proper procedures when he left his State appointed job at Departmentale Direction d' Equipment (DDE) and went to work for Semsamar. Beaud also got eight months suspended sentence while he was banned from working in any public function for a period of three years. On November 18th, 2012 Yannick Beaud appeared before the court on three charges which showed he engaged in conflict of interest from December 2009 to December 2010 and from May 1st, 2011 when he took leave of absence from the State to work for Semsamar. The case against Yannick Beaud was tried on December 15th, 2012. In December during the trial, Prosecutor Flavien Noailles told the court that Beaud acted against the law when he worked for the State and at the same time worked for a private company on similar dossiers. Prosecutor Noailles said Beaud was wearing two hats while he did not apply the requirements of the law to abstain from working for private companies for a period of three years. The defense lawyers for Beaud told the court during the trial that Beaud had received consent from two Prefets that were working on St. Martin. Those Prefets were Dominique La Croix and Jacques Simmonet.
It should be noted that Beaud left his State appointed job shortly after he secured European funding for the Caisse des Ecoles and the Abattoir. Both projects were commissioned by Semsamar and Yannick Beaud was the engineering specialist who was supposed to overlook the projects and ensure they were built in conformity with State regulations. To date, the Abattoir cannot function because they were built on the same property and in close proximity of each other causing a health and hygiene concern.
Also condemned on Valentine's Day is the former head of Urbanism Josi Carti. The Court also found Carti guilty of acting in conflict of interest when he worked on a building permit for his own company. Carti had applied for a building permit for his company Societe Civile de Construction Vente SCCV "Tropicana" that was granted to him in a little over two weeks. The file was handled between 2002 to 2003. The court found that Josi Carti abused his power, thus they condemned him to two months suspended sentence with a fine of Euros 5000.00. The court also forbid Josi Carti from working as a civil servant for a period of three years.
Josi Carti and the third Vice President of the Collectivity of St. Martin Guillaume Arnell along with the owner of SINDEXTOUR Norbert Luftman have to return to court on March 21st to answer charges of fraud and obtaining monies that were not due to them and the use of fraudulent documents when they issued an Autorisation d'Occupation Temporaire (AOT) to the owner of SINDEXTOUR Nobert Luftman.
