In the past month, Police and The Public Prosecutor's Office investigated two serious violent crimes on Saba. In the last case, concerning a serious violent act in The Bottom on January 31st, the suspects are still in preventive custody. Last Friday they were transferred to the house of detention on Bonaire. It regards M.G.H and L.H.
In the first case, concerning a case of domestic violence on January 19th, the suspect was released by the examining judge (rechtercommissaris). This was subject to conditions. The initials of this suspect are P.H-N.
There are differences between these investigations of violence. In the case of P.H-N. The Public Prosecutor's Office did request that the suspect be held in custody longer, however this was not allowed by the court appointed examining judge (rechtercommissaris). However, so long the investigation was still ongoing, his passport was withheld.
The suspect had to remain on Saba during the investigation. Particular in this case is that the suspect as well as his victim did not want to remain on Saba but return to Canada. The victim left the island shortly after the violence and with that the chance for recurrence was small. Meanwhile, the investigation has been completed and the suspect has left the island. There are indications that the authorities in Canada are now also actively involved with the matter. There, the most focused efforts can be made to prevent repetition and for any assistance. Moreover, the suspect has been indicted to appear before a judge on Saba on 16 June upcoming.
In the case of M.G.H. and L.H., the excessive violence has taken place on the public road. As a result, the impact on the feeling of security is far greater. In legal terms, there is a greater infringement of the rule of law than with violence in a relationship. That infringement may be a major reason for remand. The police investigation also learnt that there has been a long-running conflict. That makes the chance of repetition or continuation of the violence much greater. That too is a reason to detain the suspects. One of the suspects was already convicted for assault.
Finally, the violence used was of such that, a prison sentence longer than the time that the men are in custody is obvious. And the effect of punishment is the largest if that penalty immediately follows the violence. In the past month it pertained violent cases, but these differ so much that they actually are not comparable.
Verloop van geweldszaken op Saba
In de afgelopen maand hebben politie en Openbaar Ministerie twee ernstige geweldsdelicten op Saba onderzocht.
In de laatste zaak, betreffende een ernstige geweldpleging in The Bottom op 31 januari, verblijven de verdachten nog steeds in voorlopige hechtenis. Zij zijn afgelopen vrijdag overgebracht naar het Huis van bewaring op Bonaire. Het gaat om M.G.H. en L.H.
In de eerste zaak, betreffende een geval van relationeel geweld rond 19 januari, is de verdachte door de rechter-commissaris op vrije voeten gesteld. Zij het onder voorwaarden. De intitalen van deze verdachte zijn P.H-N.)
Er zijn verschillen tussen deze geweldsonderzoeken.
In de zaak van P.H-N. is door het Openbaar Ministerie wel gevraagd om de verdachte langer in hechtenis te mogen houden, maar dat is door de rechter-commissaris niet toegestaan. Wel is, zo lang het onderzoek nog liep zijn paspoort ingenomen. De verdachte moest tijdens het onderzoek op Saba blijven. Het bijzondere is ook dat zowel de verdachte als zijn slachtoffer niet op Saba wilden verblijven maar naar Canada wilden terugkeren. Het slachtoffer heeft kort na het geweld het eiland al verlaten en daarmee was de kans op herhaling klein.
Inmiddels is het onderzoek afgerond en de verdachte heeft het eiland verlaten.
Er zijn aanwijzingen dat de autoriteiten in Canada zich ook actief met de kwestie bezig houden. Daar kan ook het meest gericht worden gewerkt aan voorkoming van herhaling en eventuele hulpverlening. Overigens is de verdachte gedagvaard voor de rechter op Saba op 16 juni aanstaande.
In de zaak van M.G.H. en L.H. heeft het buitensporige geweld plaatsgevonden op de openbare weg. Daardoor is de impact op het veiligheidsgevoel veel groter. In juridische termen is er sprake van een grotere inbreuk op de rechtsorde dan bij geweld in een relatie. Die inbreuk kan een belangrijke reden zijn voor voorlopige hechtenis. Ook leert het politie-onderzoek dat er sprake is van een langlopend conflict. Dat maakt de kans op herhaling of voortzetting van het geweld veel groter. Ook dat is een reden om de verdachten vast te houden. Een van de verdachten is al eerder veroordeeld wegens geweldpleging.
Tenslotte is het gebruikte geweld zodanig geweest dat een gevangenisstraf die langer is dan de tijd dat de mannen in hechtenis zitten, voor de hand ligt. En het effect van straf is het grootst als die straf meteen volgt op het geweld.
Het ging in de afgelopen maand dus over geweldszaken, maar deze zaken verschillen zozeer dat zij eigenlijk niet met elkaar te vergelijken zijn.
