Dr. Michel Petit Wins Injunction filed by SMMC for Patients files.

Philipsburg:--- The court of First Instance has ruled in favor of Dr. Michel Petit on Monday said attorney at law Jairo Bloem on Tuesday. The St. Maarten Medical Center filed an injunction against Dr. Petit claiming that his patient's files belonged to the medical institution where Dr. Petit practiced for a number of years. According to Bloem, the Director of the St. Maarten Medical Center was fully aware that Dr. Petit was leaving the St. Maarten Medical Center on December 31 and they did not request his patient's files.
Bloem said Dr. Petit consulted with all his patients prior to his retirement and offered them their files. Some of the patients took their files while there are others who did not want the files. Those persons who did not want their files back had them turned over to Dr. Randall Friday from the Women's Health who is also a gynecologist at the St. Maarten Medical Center. Bloem said Dr. Petit will be working as a consultant with Dr. Friday and as such he is able to offer advice to Dr. Friday for the patients he treated. During his years of practice Dr. Petit rented an office space at the St. Maarten Medical Center which he occupied until he retired on December 15th 2010.
The court ruled that Dr. Petit as the treating physician was within his rights to turn these files over to his successor, Dr. Friday. The SMMC demand was therefore rejected by the court, and was ordered to pay Dr. Petit's legal expenses to the tune of Naf. 1500.
