george21082009Member of Parliament George Pantophlet for the lack of a stronger word finds it totally ridiculous and a complete abuse of power that Simpson Bay Resort is appealing the verdict of the judge in the Court of First Instance. This will probably be the sixth time that this case is going to courts. But again the game is who has the deepest pockets. It reminds him of the person that came to his office inquiring what to do about an employer for whom they had worked 16 years. The judge ruled in the employee's favor but was told by their employer and let me paraphrase, you will never get a cent, I have more money than you, so take it to courts again. Almost 3 years have gone by and the employee has not received a penny. He understood that Simpson Bay Resorts plans to close the Resort on Saturday because they don't have the money to pay. My question is have they presented any financial statements to the labor department or government detailing their financial situation? Are their taxes up to date? Have they not been paying third parties to work in the place of the displaced workers? Why don't they tell the people of St. Maarten how much money they have to pay the workers in accordance with the collective labor agreement? The Member of Parliament suggests that they (Simpson Bay Resort) can look into their overseas accounts where they hold most of the funds generated on St. Maarten to pay what is owed to the workers. It is time government steps in on behalf of the workers of this Resort and the people of St. Maarten in general. They (Government) are the ones that issued the license to Simpson Bay Resort they are the ones that held on to the $1.2 million transfer fee for months before actually depositing it. Appeals, Appeals, and more Appeals the Member of Parliament would truly like to know what it has cost the Unions and by extension the workers in legal fees. And just to be impartial also how much the Resort has paid in legal fees. Appeals, Appeals and more Appeals while the workers and their families are suffering. What a way to start your Easter Holidays.

    Uhhhmmm. When exactly was the license issued to Simpson Bay Resort?????? Please do tell MP Pantophlet.

    It was predicted by someone, in an earlier post, that the resort will close, looks like we have psychics on this site boy. ;-)

    Americans are funny people when it comes to their money. Just look at Lago in Aruba. When pressured, they pull out. You can ask all the questions you want, you cannot force them to open their doors.

    Is this what we want to see happening in a chain reaction??? Is this to become another "Mullet Bay"?????

    People better to wake up and smell the coffee. For many years we provided for our Northern bro's and sis'. However, there is no work on the Northern side to help us out when all businesses on the Dutch side start closing up shop.

    I don't care anymore, I will say this bluntly ...... for who are many others going to be made to suffer???? Where are the many (young) locals that were put out of work by this whole saga???? I am sure that many of the temp workers were also locals.

    Don't just blame Govt. .... Blame all who brought this saga to where it is today .... Including you MP Pantophlet and Co. :sad: :sad:

    Owners of the Resort. Close down the resort for good and then sell it. No judge can tell you what to do with the resort money, it is not theirs or the authorities. I will like to see where WIFOL will get 2 cents for their members. Look at Food Center, Mullet Bay cases. Persons worked there for years too but ended up with nothing. Lessons to be learnt. Only lawyers getting rich. Two dogs fighting for a stick and the 3rd dog running away with that same the stick ;-) ;-) You think that the persons or company that buys that resort will want a Union there. Not me forsure. I know when hiring in my new company all will get a document to sign not to unionise. If not signed , not hired. Our own real SXM born persons are the ones without work all about and WIFOL fighting for work for foreigners. I hope Wifol and his hungry lawyers do not succeed.

    i will defend the Mullet Bay case as i was a worker there, ALL Mullet Bay employees were paid out, there were many lists that was sent out from the Labour Departement on who was being terminated, it was the persons decicion to either to be paid out by Mullet Bay as Early Retirement or be paid as what was given from the Labout Department. Early Retirement had a benefit of getting more money added on to what you were actually gonna get, as to avoid the process with Labour Deparment. Most took the Early Retirement. I did as i was very young and could have moved on easily. The on going case of Mullet Bay had nothing to do with employees, it was the Home Owners. Mr Ansari saw best to knock down all of the Bungolows in order to build more high rise buildings just like The Towers, which he owns as well. The Home Owners did not want that and he refused to pay The Home Owners out, not the employees.

    and to conclude, Mr Judas James was working in Mullet Bay at the same time as well. He was heartless then, he was Heartless in Flamingo Beach Resort and he still Heartless, but an eye for an eye and a tooth for a tooth, James your days are coming soon, the good book that u preach in will not save u, God don't like ugly, and u commited a great sin, to not feed ur flock, wether they go to ur church or not, they are still ur flock, u took an oath to "proctect and serve the people", but i guess the word "People" was mistakingly overheard as "Self", ur a wicked and disgraceful man to this community, u may hide ur head in the soil like an Ostrich but u will still be seen as an Ogre

    I hope this case is a pro bono.

    The lawyers stand much to gain from this case.....do it for free. Take it to the top. If you win this case, you win big time!!!

    MAYBE MR DUNCAN CAN GET IT FOR THE PRISON....HEE HEE

    OR THE MEW MEDICAL TOURISM CENTER, FOR WHICH IT MIGHT BE PERFECT, AS I HEAARD ON ORAL GIBBES SHOW, IT WILL BE READY IN 2-3 YEARS.

    The Pope has a job for life. US Supreme Court justices have jobs for life. Dictators (possibly) have jobs for life. WIFOL workers...jobs for life? Please. The union is too shortsighted to see that if the result of their actions is that Simpson Bay Resort closes, not only will they be out of work but the economy of the entire island will be negatively impacted. It seems that those in positions of influence are too easily distracted by short term gains instead of long term consequences. Go ahead and watch tourists abandon the traffic-clogged island of SXM. How will WIFOL members fare then?

    The "real" owners asked the governement to step in 18 months ago and help us. RR and QIT were killing us with exsessive fees and unreasonable terms. We were willing to have the government to step and take over the loan and we would let them hold the note while we paid them off rather than dealing with the 3 devils (Corso, Sutton, and James).

    If the SXM government had done for us what the US govt did for GM none of this drama would have happened. The resort would have never closed, the govt of SXM would be making money on the deal with the intrest we would have been paying, and the workers would have never been treated fairly and would still be working.

    No one wants to see the the SXM govt in the timeshare business but hindsight being what it is, would it have been any worse if they had? Is it too late for them to jump and and make things right? SXM govt: Pay off the 3 devils, take over the resort, make a deal with the "real" owners, and lets get things FRIENDLY again!
