Yanick Beaud facing Eight Months for Not Respecting State Regulations --- Decision on Valentine’s Day 2013.

Marigot:--- State employee Yanick Beaud is facing eight months suspended sentence, a 5000.00 Euros fine, and a period of three years where he cannot work for the State or Semsamar. These were the demands of the Prosecutor Flavien Noailles on Thursday when Beaud appeared before the court for not respecting and following state rules to get leave of absence to work for a private company.

Beaud appeared in Criminal Courts on Thursday to answer charges that were brought against him by the prosecutor because Yanick Beaud did not follow the basic and proper procedures to leave his State appointed job at DDE to work for Semsamar in 2011. According to the Prosecutor, Yanick Beaud sought the advice of two former Prefet Delegue of St. Martin, namely Domique La Croix and Jacques Simmonet. It is believed that both State employees were friends of Yanick Beaud and he received a written advice from Simmonet and La Croix who apparently gave Beaud the permission to leave his State job and work for Semsamar. Prosecutor Noailles in his arguments said that it is impossible for Beaud to seek advice from State employees and bypass the normal procedures to obtain permission to leave his State job so that he could work for a private entity. The prosecutor further stated that Beaud is not above the law and he will make an example of him since he knew better.

The panel consisting of three judges asked Beaud if he did not think that he had an obligation to the State and to ensure he followed basic and moral procedures when he took up the offer to work for Semsamar. The court will pronounce its judgment on February 14th, 2013.

Beaud was an employee of the State and he was working at DDE office on St. Martin when he abandoned his job at DDE and went to work for Semsamar. It should be noted that Beaud left his State appointed job shortly after he secured European funding for the Caisse des Ecoles and the Abattoir. Both projects were commissioned by Semsamar and Yanick Beaud was the engineering specialist who was supposed to overlook the projects and ensure they were built in conformity with State regulations. To date the Abattoir cannot function because they were built on the same property and in close proximity of each other causing a health and hygiene concern.
