Statement of the Facts
Facts
The First Petitioner (Evmolpia Private Foundation) is registered and functioning in Sint Maarten (Annex 1). Before 10.10.2010 Sint Maarten was part of the Netherlands Antilles. With effect from 10 October 2010, the Netherlands Antilles ceased to exist as a part of the Kingdom of the Netherlands. From that date onwards, the Kingdom consists of four parts: The Netherlands, Aruba, Curaçao, and Sint Maarten.
The Second Petitioner (Yordan S. Busarov) is a Bulgarian citizen, living and working in Sint Maarten (since the year 2000) (Annex 2). Both Petitioners are referred below as The Petitioners.
Since April 27,2012 the Petitioners are under illegal house-arrest, which is aiming to cover up criminal activities within the jurisdiction of the Kingdom of the Netherlands (Annex 3)! I quote:
DECISION
The examining judge in bankruptcy:
Suspends the order of remand in custody ordered against Yordan Stoilov Busarov pursuant to article 85 Fb effective Friday April 27th 2012, 12:00 hours.
Thereby sets the following conditions:
that the suspect complies with the provisions in article 86 Fb, namely that he may not leave his residence without permission of the examining judge;
On Nov 25,2011 The Applicants filed Complaint to the Office of Her Majesty Queen Beatrix (Kabinet der Koningin) against the President of the Supervisory board Mrs. L.Hoefdraad and Vice President of the Joint Court of Justice Judge Mr. R.W.J. van Veen, and requested investigation. On December 13, 2011 (on behalf of The Director of The Queen's Office) Mw.mr.M.Beuker forwarded the Complaint to the Govenor of Sint Maarten. On Feb 13,2012.the Director of the Cabinet of the Governor of Sint Maarten Mr. Rob(J.H.) Bats forwarded the Complaint (Annex 11) to the President of the Board the Joint Court of Justice, as required by Rijksbesluit rechtspositie Gemeenschappelijk Hof van Justitie Artikel 53(1).
Since Feb 13,2012 (for over one year) Het bestuur van het Gemeenschappelijk Hof van Justitie van Aruba, Curaçao, Sint Maarten en van Bonaire, Sint Eustatius en Saba (Gemeenschappelijk Hof van Justitie) refuse to investigate the Complaints (Kenmerk: NO 12 – 13/SvdO/lg en Kenmerk: REK 11.002323) against the improper behavior of De President van het Gemeenschappelijk Hof van Justitie Mrs. Lisbeth Hoefdraad en the Vice-President Mr. R.W.J.Van Veen in breach of Rijksbesluit rechtspositie Gemeenschappelijk Hof van Justitie Artikel 53 (2,3 en 4), Artikel 54, Artikel 55, Artikel 56, Artickel57, Artikel 58, Artikel 59, Artikel 60, Artikel 61, Artikel 62, Artikel 63 en Artikel 64!
Since March.30.2011 the Petitioners informed numerous times (on March.30.2011, April.18.2011, October. 07. 2011, on Feb.06.2012 March.05.2012 and June.04.2012...etc) the Attorney-General's Office of the Supreme Court of the Netherlands of the improper behavior of the President of the Court Judge Mrs. L.Hoefdraad and the Vice-President Judge Mr.R.W.J. van Veen, and requested investigation, as required by Wet op de rechterlijke organisatie (Wet RO) Artikel 13 a! Since March.30.2012 - up to date – March.18.2013. the Complaints are disregarded/not handled in breach of Wet op de rechterlijke organisatie Artikel 13 b, Artikel 13 c, Artikel 13 d, Artikel 13 e, Artikel 13 f, Artikel g, and Artikel 13 h Wet RO)!
According to the knowledge of the Petitioners, effective August.2013 (this year) the Vice-President of Judge Mr.R.W.J. van Veen will be no-longer part of Gemeenschappelijk Hof van Justitie!
On Martch.15.2013 the Minister of Justice Mr. Nelson Navarro (Curacao) informed the publicity that, effective August.2013 (this year) the President of Gemeenschappelijk Hof van Justitie Judge Mrs. L.Hoefdraad will retire (Annex 4 or Please go to http://www.kkcuracao.com/?p=23743
It is a fact that the Dutch Judges are appointed for life, until they retire at their own request or at the age of 70! Rijksbesluit rechtspositie Gemeenschappelijk Hof van Justitie Artikel 19 lid 5 clear state:
5. Een lid van het Hof kan vanaf het bereiken van de leeftijd van achtenzestig jaar aanspraak maken op wekelijks een halve vrijdag verlof en vanaf het bereiken van de leeftijd van negenenzestig jaar op een hele vrijdag verlof met behoud van salaris. Dit verlof kan niet worden opgespaard en vervalt bij ziekte en onbezoldigd verlof.
In fact the Knight in the Order of Orange-Nassau (Annex 5 or please go to http://www.aboutwomenconference.com/engels/lisbethoefdraad.htm ) and President of the Gemeenschappelijk Hof van Justitie Judge Mrs. L.Hoefdraad (1951) will retire at age 61 (or 62-unknown) and will not/refuse to have the privilege of (after reaching the age of sixty-eight years) a weekly half Friday and (after reaching the age of sixty-nine years) on a leave on whole Friday leave with salary.
The opinion of the Petitioners is that the following questions should be asked:
Is it the ill treatment, illegal punishments, acts of arbitrariness, acts of direct coercion, flagrant acts of intimidation and severe destruction of the fundamental human rights against/of the Petitioners the only way to protect the image and the trust in the Dutch Judiciary?
Why the Member of the Constitutional Court of Sint Maarten, Vice-President of the Gemeenschappelijk Hof van Justitie and Member of the bestuur van het Gemeenschappelijk Hof van Justitie (Rijkswet Gemeenschappelijk Hof van Justitie Artikel 40 lid 1) Honorable Justice Judge Mr. Jan de Boer is "blind and deaf" for the severe destruction of the Rule of Law?
Why the Honorable Governor of Sint Maarten Mr. Eugene Bernard Holiday refuse to assure (for over a year- since Feb.13.2012) the implementation of the Kingdom Laws (Rijksbesluit rechtspositie Gemeenschappelijk Hof van Justitie Artikel 53 (2,3 en 4), Artikel 54, Artikel 55, Artikel 56, Artickel57, Artikel 58, Artikel 59, Artikel 60, Artikel 61, Artikel 62, Artikel 63 en Artikel 64 )?
What will be the next illegal punishment against the Petitioners (for requesting Proper Administration of Justice, speaking the truth and ask questions)-Death Penalty?
How all and above can be possible within the Jurisdiction of the Kingdom of the Netherlands (one of the founding members of the Council of Europe)?
...etc?

The Petitioners will continue to inform the publicity (if alive) of the further communications (and/or illegal punishments) with/from the Gemeenschappelijk Hof van Justitie!
