Marigot:--- The owners of Bikini Beach and Kontiki Beach are still waiting on a response from the Collectivity of St. Martin regarding a letter their lawyer send to Territorial Council of St. Martin on April 2nd, 2013 asking that the council intervene and stop the owner of SINDEXTOUR from evicting them from their business place situated on AW33 Orient Bay. Bikini Beach has been operating on Orient Beach for the past 20 years while Kontiki Beach has been operating at the location for 7 years, the open letter states.
The court of commerce in Basse Terre, Guadeloupe ruled in favor of SINDEXTOUR who filed an injunction requesting that the court grant him permission to evict the two businesses from the parcel of land that the Collectivity of St. Martin granted an AOT to SINDEXTOUR for while refusing to recognize and treat the request that was submitted by Bikini and Kontiki Beach.
The two business persons filed a complaint against the Collectivity of St. Martin and the owner of SINDEXTOUR who are now before the Criminal Courts of St. Martin regarding the AOT that was granted to Norbert Luftman, owner of SINDEXTOUR.
It should also be noted that while three persons namely Third Vice President Guillaume Arnel, Jose Carti (Former Head of Urban Planning), and the owner of SINDEXTOUR are scheduled to appear before the criminal courts on September 19th, 2013 regarding the AOT that was granted to SINDEXTOUR, the heirs of Daniel Beauperthuy, the legitimate owner of AW33, are also contesting the courts for the property that was given to the State while the property belongs to the Beauperthuy families. It is not yet clear when the Supreme Court in France will render its verdict on the Beauperthuy's claim.
