Why did Minister of VSA appoint Carty retroactive to 2014?
PHILIPSBURG:--- The appointment of the interim director now director of USZV has raised a number of questions based on documents SMN News obtained. One has to now question if Carty was acting and or signing agreements on behalf of USZV illegally. While Carty was appointed by word of mouth to the position of interim director of USZV on July 1st, 2015 to June 30th, 2016. The Gumbs cabinet only took a decision on October 14th, 2015 where they made the appointment official and retroactive to July 1st, 2015, while the Chairman of Supervisory Board of Directors (SBOD) was informed officially of the appointment on October 27th, 2015 by the then Prime Minister Marcel Gumbs.
While Carty’s appointment expired on June 30th, 2016, he continued to work and committed SZV (AOV) funds during the month of July and August 2016 while he had no official working agreement.
What is more questionable is the Landsbesluit signed off within four days by Governor Holiday on August 4th, 2016.
The documents which that is below the article shows that the SBOD of USZV sent in a proposal to the Gumbs cabinet on September 3rd, 2015 to appoint Carty as the Director of USZV while he was in possession of a contract that expires on June 30th, 2016.
The LB continues to show that Carty was appointed Director of USZV for an unlimited period of time even though he has another full-time job as the CEO of UTS St. Maarten. Further to that, the LB that was signed by Governor Holiday on August 4th, 2016 is retroactive to December 1st, 2014, almost six months before Carty was ever working at USZV as the interim director, Carty was at the time a board member of the SBOD and he was not screened until July 2016 by the SBOD for the director's position. While the screening was done by the SBOD it was something the Minister of VSA had to do before the appointment was made. Now the question one would have was the Governor of St. Maarten sleeping when he signed off this LB for anunending period for someone who was not screened for the director's position in December 2014?
There are a number of questions on the appointment of Carty since the dates on the decisions and or contracts simply does not match. One of the biggest question is why did the current Minister of VSA appointed Carty to the position as Director of USZV to December 1st 2014, while the Minister himself was not in office. Secondly, why would he appoint Carty to the position for an unlimited period of time and why was this LB not done in a timely manner to avoid Carty from committing USZV while he was not legally appointed as the director or interim director.
