PHILIPSBURG:--- The prosecutor’s Office will not prosecute any of the suspects in the fatal traffic accident involving a toddler on Saturday, August 20, 2016, in front of the Princess Juliana International Airport Arrival hall. The toddler ran across the street and was struck by a passing shuttle bus. He died at the scene from the injuries sustained.
Both the driver of the bus, as the toddler’s father were considered suspects in the investigation. The two men, as well as a number of witnesses, were heard by the police. In addition, trace evidence collected from the scene and analyzed by the Traffic Department of the St. Maarten Police Force and secured video images from the Airport which captured the incident, were evaluated in the investigation.
Regarding the shuttle bus driver, it cannot be established, taking into account the conditions at the scene, that the speed he was driving was too high, that he had not paid enough attention to his surroundings or that he has otherwise made a traffic offence. As a result, he cannot be blamed in a criminal way for the incident. As it pertains to him, it was a tragic accident.
Concerning the father’s actions (leaving his young children unattended in a car with the front door open on a public road with heavy traffic) it could be considered - in view of his obligation to take care of his children – that he was so irresponsible that he might be considered criminally culpable. However, the Prosecutor’s Office, in this case, doesn’t find it appropriate to prosecute the father, given the disastrous effect that he has lost his child due to the accident.
Stafrechtelijk onderzoek naar dodelijk ongeluk gaande
Het Openbaar Ministerie zal niet overgaan tot vervolging van de verdachten in het dodelijk ongeluk voor de aankomsthal van de Princess Juliana International Airport op
20 Augustus 2016. Hierbij verloor een peuter het leven. Het jongetje rende onverwacht de straat op terwijl er een shuttle bus voorbij kwam rijden.
Zowel de chauffeur van de bus, als de vader van het jongetje zijn in het onderzoek als verdachte aangemerkt. Beiden zijn door de politie gehoord, alsmede een aantal getuigen. Daarnaast is in het onderzoek gebruik gemaakt van het sporenonderzoek
uitgevoerd door de verkeerspolitie en van veiliggestelde videobeelden van de luchthaven, waarop de toedracht te zien is.
Ten aanzien van de chauffeur kan niet worden vastgesteld dat zijn snelheid, gelet op de omstandigheden ter plaatste, te hoog was, dat hij onvoldoende aandacht had voor zijn omgeving of dat hij anderszins een verkeersfout heeft gemaakt. Dat heeft tot gevolg dat hem in strafrechtelijke zin geen verwijt te maken valt. Ten aanzien van hem geldt
dat het een tragisch ongeluk is.
Van het handelen van de vader (het zonder begeleiding op een openbare weg met druk verkeer achterlaten van zijn jeugdige kinderen in een auto waarvan het voorportier open staat) zou gezegd kunnen worden dat het – gelet op zijn zorgplicht – zodanig onverantwoordelijk was, dat het wellicht strafrechtelijk verwijtbaar is. Echter, het Openbaar Ministerie vindt in dit geval de vervolging van de vader niet opportuun, gelet op het verschrikkelijke gevolg dat hij zijn kind heeft verloren.
