Ansary ordered to pay more than one billion in damages.

Willemstad/Philipsburg:---This morning, the Court in First Instance of Curaçao gave a verdict in the liability process of the Centrale Bank van Curaçao en Sint Maarten (CBCS) on behalf of Ennia against the (ultimate) shareholder and former directors of Ennia. The court ruled in CBCS’s favor and ordered Ansary, his daughter, and the former directors to pay Ennia more than one billion guilders in damages.
The verdict rendered on Monday condemns Ansary and his daughter Nina Ansary to pay the legal and extrajudicial costs endured by Ennia in respect of each of them. Due to the size and financial importance of the case, the attorney's salary will be estimated at NAf 25,000 per point.
With regard to the other defendants, the parties are partly in the right and partly in the wrong, in view of what has been claimed and what can be awarded. Compensation for litigation costs is also appropriate.
Ennia et al. has not quantified and specified its claim for compensation for extrajudicial collection costs in these proceedings, although there has been every opportunity to do so. It is clear, however, that such costs have been incurred. The court will pay these costs in this judgment with due observance of article 126 sub III
Civil Procedure Rules for each of Ansary and Nina Ansary estimated at NAf 37,500 (one and a half points x rate applied) and for the other defendants always at NAf 9,000.
6.3. orders Ansary and Van Doorn jointly and severally to pay Ennia cs NAf 10,574,500 and Ansary, Andraous and Palm furthermore jointly and severally to pay Ennia Investments NAf 10,217,470, plus the statutory interest from the moment of payment of the relevant donations until the day of complete satisfaction; related costs consultants
6.4. orders Ansary and Andraous jointly and severally to pay Ennia Investments NAf 4,436,250 and Ansary furthermore to pay NAf 1,700,000, plus the statutory interest from the moment of payment of the relevant costs until the date of full payment; relevant salaries to persons who were not employed

 6.5. orders Ansary and Van Doorn jointly and severally to pay Ennia et al. of NAf 608,363, and Ansary furthermore to pay NAf 788,429 and Ansary, Andraous and Palm furthermore jointly and severally to pay NAf 4,237,392, plus the statutory interest from the moment of payment of the relevant costs up to the day of full payment;

6.6. orders Ansary and Van Doorn jointly and severally to pay Ennia et al. NAf 315,770, and Ansary furthermore to pay NAf 1,377,238 and Ansary and Nina Ansary further jointly and severally to pay NAf 436,440, and Ansary, Van Doorn and Nina Ansary furthermore jointly and severally to pay of NAf 1,737,374, and Ansary and Nina Ansary further jointly and severally to pay NAf 881,064, and Ansary, Andraous, Palm and Nina Ansary further jointly and severally to pay NAf 9,486,423, plus the statutory interest from the moment of payment of the relevant rewards up to the day of full satisfaction; to the point NetJets
6.7. orders Ansary to pay Ennia Investments NAf 5,522,781, and Ansary and Van Doorn furthermore jointly and severally to pay NAf 2,319,730, and Ansary, Andraous, and Palm furthermore jointly and severally to pay NAf 19,879,770, plus the statutory interest from the moment of payment of the relevant costs until the day of payment in full; in respect of extrajudicial costs and legal costs.
6.8. orders Ansary and Nina Ansary each to pay Ennia et al. of NAf 37,500 and each of the other defendants to pay NAf 9,000;
6.9. orders Ansary and Nina Ansary jointly and severally to pay the legal costs incurred by Ennia et al., estimated to date at NAf 15,000 in court fees, NAf 1,418.92 in writ costs, and NAf 100,000 for attorneys' fees, increased by subsequent costs of NAf 250 without service and NAf 400 with service, all amounts in the event of non-payment, plus the statutory interest from the fifteenth day after the decision of this judgment;
6.10. compensates the other costs of the proceedings in such a way that each party bears its own costs;
6.11. declares this judgment provisionally enforceable;
6.12. rejects the more or otherwise advanced.
