PHILIPSBURG:--- The suspended statutory director of NV GEBE Merril Temmer has dispatched a lawyers letter to the Supervisory Board of Directors, and Shareholder representatives demanding that he be reinstated since he was not responsible for the ransomware attack of March 16th, 2022.
Represented by Berman Keuning the letter that was sent on Wednesday states that Temmer had limited power when he was appointed Temporary Manager and his only assignments were to deal with urgent matters.
The letter went on to state that even though Temmer was the IT manager for a number of years he is not responsible for the state of affairs of GEBE IT department because he as manager sounded the alarm several times, which he said can be proven by the various reports he wrote over the years.
The attorneys representing Temmer attacked the legality of the two-member Supervisory Board of Directors and even stated that the Shareholder was responsible for appointing an incompetent Supervisory Board.
Berman and Keuning also rejected the claims by the Prosecutor’s office saying that NV GEBE did not cooperate with the investigation launched by KPSM and the prosecutor's Office, they claimed that Temmer cooperated with law enforcement as best as possible.
The law firm in its letter said that the shareholder has a responsibility to defend the statutory director and the company instead of ordering an illegal investigation.
The letter further stated that if government had doubts or questions about the role the statutory director played during the hack then the shareholder should have ordered the prosecutor's office to conduct an inquiry.
The law firm further concluded that Troy Washington was illegally appointed as he as the statutory director had annulled the appointment of Troy Washington as such they are calling on the Supervisory Board of Directors and the Shareholder to reinstate Merril Temmer as the Chief Operations Officer or face court litigations.
